Governor Tom Wolf Issues New Executive Order

Pennsylvania Governor Tom Wolf issued a new executive order on April 15, 2020, which takes effect at 8:00 PM on Sunday, April 19, 2020 at 8:00 PM, that directs, among other things, the wearing of masks by the public. 

The order reads, in part:

“In addition to the social distancing, mitigation and cleaning protocols, businesses that serve the public within a building or defined area are ordered to implement the following, based on the size of the building and number of employees:

Require all customers to wear masks while on premises, and deny entry to individuals not wearing masks, unless the business is providing medication, medical supplies, or food, in which case the business must provide alternative methods of pick-up or delivery of goods, except individuals who cannot wear a mask due to a medical condition (including children the age of 2 years) may enter the premises without having to provide medical documentation;”

It is the interpretation of CAI and the Legislative Action Committee that this specific section of this specific order does not apply to condominiums, cooperatives and planned communities in Pennsylvania because they are not “businesses that serve the public.” However, we do interpret the rest of this executive order to apply to c condominiums, cooperatives and planned communities as they have been granted a waiver to a previous executive order and are permitted to continue to operate as life-sustaining operations. 

CAI does recommend that community associations, management and staff follow the recommendations contained in this and other orders issued by the Department of Health and the CDC.
