Governor Shapiro Signs House Bill 1716 into Law

In addition to other provisions, this legislation restores the ability to register as an unincorporated association in the Commonwealth of Pennsylvania, which impacts many community associations in the Commonwealth

House Bill 1716 was introduced by Rep. Perry Warren (D-Bucks County) on September 26, 2023. According to Rep. Warren’s co-sponsor memo, “the legislation cleans up some language in several subsections of Title 15. These are technical changes to ensure clarity and continuity.”

CAI’s Pennsylvania Legislative Action Committee (PA LAC) supported an amendment that restores the ability to register with the Department of State as an unincorporated association. Many community associations through the years have registered in this way with the Department of State. However, legislation was adopted in 2022 that amended Title 15 – regulating Corporations and Unincorporated Associations. In the process, the ability to register as an unincorporated association was removed from the statute. 

Seeing the Bill pass and become law was a top priority for the LAC this session and is pleased to have been part of the effort to correct this issue for many Pennsylvania community associations.
